Your responsibility in a flatted building doesn’t just extend to paying for common repairs.
If you are responsible for maintaining a part of a building you are required to:
- keep it in good order, so as not to cause damage to neighbours’ property and to provide support and shelter for the building as a whole
- this applies to items which are individual responsibility as well as mutual or common elements of the building
- pay your share of common costs
As it is a difficult task to maintain common parts on your own when the responsibility is shared with the other owners, it is always advisable to establish an owners’ association or appoint a property manager (factor) to act as a central body to fulfil the common responsibility.
It should be kept in mind that employing a factor may not be enough to fulfil this duty and each owner still needs to take an active role in the common maintenance of the tenement.
