Following the publication of the Scottish Law Commission’s report on compulsory owners’ associations, the Commission has released a new video overview of its contents.
In December 2025, the Scottish Law Commission published a report recommending that the Scottish Government introduce compulsory owners’ associations in tenement buildings in Scotland. The report recommended that tenement owners should have a legal duty to hold at least one annual meeting of an owners’ association, appoint a manager, and approve a repair budget for their building. Its publication was welcomed by Under One Roof as a crucial step forwards in improving Scotland’s tenement stock.
In this new video overview, Professor Frankie McCarthy, lead Commissioner for the report, explains the context of the wider tenement law reform project, discusses current tenement law and what needs to change, and explains how the recommended compulsory owners’ associations might work in practice.
