Maintenance orders are often used as a follow-up to other notices to avoid future repair problems.

A Maintenance Order requires owners to produce a plan to maintain their property to a reasonable standard. Notices can last for five years.

Owners are required to set up and implement a maintenance plan that states:

  • what needs to be done
  • when
  • costs
  • owners’ respective share of costs
  • payments into maintenance accounts
  • how the process should be managed – you may be required to take on a professional property manager

If owners do not set up a maintenance plan, the council can step in and then charge owners.

Like Work Notices, these can appear in your title deeds when you come to sell your flat.
