Impact of the Property Factors Act

In the summer of 2017, the Scottish Government carried out a review of the Property Factors (Scotland) Act 2011. This is a summary of what they found.

Since the Property Factors (Scotland) Act 2011 came in to force:

  • around 400 property factors are currently registered
  • 620,000 properties are currently searchable on the register
  • 60% are managed by private sector factors, the rest by local authorities and housing associations
  • 65 new factors have registered in the past year
  • six factors were removed from the register as they no longer met the considerations for entry
  • 70 property factors chose not to re-apply for registration after their original three year registration expired  
  • around 700 applications were made to the Home Owners Housing Panel between 2013 and 2015
  • the number of applications has gone down each year, although the number of complaints listed within each application has gone up
  • in the majority of complaints, it was ruled the property factor had NOT breached the code of conduct
